Terms of Service

Welcome to Crescently. These Terms of Service ("Terms") govern your use of the Crescently mobile application and website (collectively, the "Service"), operated by Varmada ("we," "us," or "our").

By downloading, installing, or using Crescently, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Relationship to Varmada Terms

Crescently is a product of Varmada. These Terms supplement and extend the general Terms of Service published at varmada.com/terms. In the event of any conflict between these Terms and the Varmada Terms, these Terms shall prevail with respect to your use of the Crescently Service. All provisions of the Varmada Terms that are not expressly overridden herein remain in full force and effect.

2. Eligibility

You must be at least 13 years of age to use Crescently. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Crescently app on your personal device for your own personal, non-commercial use.

4. Content & Intellectual Property

All content provided through Crescently — including affirmations, Quranic references, dhikr tools, illustrations, designs, and branding — is owned by or licensed to Varmada and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

Quranic verses referenced within the app are sourced from established translations and are presented for spiritual and educational purposes. We do not claim ownership over the text of the Quran.

5. User Conduct

You agree not to:

• Use the Service for any unlawful or unauthorized purpose.
• Attempt to reverse-engineer, decompile, or disassemble any part of the app.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means to access the Service without our express permission.
• Misrepresent your identity or affiliation with any person or entity.

6. Subscriptions & Purchases

Crescently may offer premium features through in-app subscriptions or one-time purchases. All payments are processed through the Apple App Store or Google Play Store and are subject to the respective platform's payment terms. Refunds are handled in accordance with the applicable store's refund policy.

Subscription pricing, billing cycles, and renewal terms will be clearly displayed before you make a purchase. You may cancel your subscription at any time through your device's subscription management settings.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. Crescently is a spiritual wellness tool and is not a substitute for professional religious guidance, counseling, or medical advice.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Varmada and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your license to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Varmada is incorporated, without regard to its conflict of law provisions.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of Crescently after any changes constitutes acceptance of the revised Terms.
